Nicole Benjamin - Benjamin Law, P.A.

Benjamin Law, P.A. understands the unique concerns that come with addressing the guardianship needs of minors. We recognize the emotional difficulties that can accompany assigning a minor a guardian, and can help guide you through this process while working to protect the rights of the child involved.

The legal guardianship of a child or children can be acquired by a non-parent in addition to physical custody. People often petition for legal guardianship on behalf of their relatives, such as grandparents, aunts, uncles, siblings, etc. The child’s legal guardian can be anyone, even someone unrelated to the child.

Guardianships Are Often Administered In Situations Where Parents Are:

  • Deceased
  • In jail or prison
  • Struggling with addictions
  • Unable to protect and provide for their children.
  • Facing other issues that make it difficult for them to care for their children

Guardianships are also filed for minors when the minor child has inherited money or property in excess of $15,000 from a deceased person, or received money from a settlement in excess of $15,000. In this case a guardian of the property is all that is needed if the minor child’s parents are living.

If a minor child’s parents are deceased or unable to be appointed guardian, he/she may need a guardian of the person and property.
