How Florida Law Defines Alimony

Alimony is financial support (that is, regular payments) that one spouse may have to provide the other during or after a divorce. It is meant to ensure that neither spouse is left without the resources they need to move forward with life after the end of a marriage. Generally, spouses with a higher income will be required to pay alimony. Of course, this is not always true, as Florida courts will order payments on a case-by-case basis, and couples can determine how to handle alimony through their own negotiations and mediation

Types of Alimony

Florida law details several types of alimony, including:

  • Durational - This type is for a specific period and is only awarded in cases involving a marriage that lasted at least three years. 
  • Bridge-the-Gap - This type is meant to help the recipient transition from married life to single life. It can last up to 2 years and cannot be modified.
  • Rehabilitative - If one spouse needs financial support while they complete education or training that will help them become self-sufficient, rehabilitative alimony may be ordered.

Modifying & Enforcing Alimony Orders

You may modify durational and rehabilitative alimony, but you cannot modify bridge-the-gap alimony. In order to seek a modification, a significant life event must have happened. This could be anything from losing your job to the alimony recipient (be it yourself or your ex-spouse) getting a significant raise.
